Service

These Terms of Service ("Terms") govern your use of Rubick, a generative photo studio operated at rubick.art ("Service", "we", "us"). By creating an account or using the Service, you agree to be bound by these Terms.

If you are using Rubick on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

You must be at least 16 years old to use Rubick. By using the Service you confirm you meet this requirement.

Rubick lets you upload reference photos and generate AI-produced images using Google's Gemini AI model. Each generation consumes credits from your account balance. Credits are purchased through our payment provider, Polar.

The Service is provided on a best-effort basis. AI image generation is probabilistic — outputs may not always match expectations. We make no guarantee about the specific quality, accuracy, or style of any generated image.

You sign in via Google OAuth. By signing in you grant Rubick permission to read your Google account email address and display name.

You are responsible for all activity that occurs under your account. Do not share your account with others. If you believe your account has been compromised, contact us immediately at support@rubick.art.

We may suspend or terminate your account if we detect abuse, violation of these Terms, or activity that harms other users or the Service.

Communications. By creating an account you agree to receive service emails: a welcome message, purchase confirmations, and notifications when your generations are ready. You can turn off non-essential notifications using the unsubscribe link in those emails or in your account settings. Essential transactional emails (such as purchase confirmations) are part of the Service.

How credits work. Each generation consumes credits from your balance as shown on the template card. Credits have no cash value and cannot be transferred between accounts.

Purchasing credits. Credits are sold in packs. All purchases are processed by Polar, our Merchant of Record. Prices are shown in your region's currency where supported (for example US dollars, Japanese yen, or Mongolian tugrik) and charged by Polar, which handles all applicable taxes.

Non-refundable. Credit purchases are non-refundable except as required by law. Credits do not expire while your account is active.

Automatic refunds on failure. If a generation attempt fails on our side — a server error, AI service timeout, or infrastructure failure — the credits consumed for that attempt are automatically refunded to your balance. You will never be charged for a generation that did not complete successfully. This automatic refund is separate from the purchase refund policy above.

Your uploaded photos. You retain full ownership of any photos you upload. By uploading photos, you grant Rubick a limited, non-exclusive, royalty-free license to transmit those photos to Google Gemini API for the sole purpose of generating the image you requested. We do not claim ownership of your photos and do not use them for any other purpose.

Generated images. You own the generated images produced from your uploads, subject to any terms imposed by Google's Gemini API regarding AI-generated outputs. You may use generated images for personal and commercial purposes. We do not claim copyright over the generated outputs.

Our content. The Rubick name, logo, website design, templates, and system prompts are owned by us. You may not copy, reproduce, or redistribute them without written permission.

You agree not to use Rubick to:

Upload illegal content. Do not upload photos that depict illegal activity, non-consensual intimate imagery, or content that violates the rights of others.

Generate harmful content. Do not attempt to generate content that is sexually explicit, hateful, violent, or designed to harass, threaten, or harm a real person.

Upload photos of others without consent. Only upload photos of yourself or people who have clearly given you permission to use their likeness with an AI generation service.

Abuse the platform. Do not attempt to reverse-engineer, scrape, overload, or circumvent rate limits, access controls, or the credit system.

AI-generated images are produced by probabilistic models. Results may vary significantly between attempts using identical inputs. Generated images may contain artefacts, inaccuracies, or unexpected content.

No guarantee of likeness. Rubick attempts to preserve identity and likeness from your reference photos, but cannot guarantee that generated images will accurately or faithfully represent the people in those photos.

Not for high-stakes use. Generated images should not be used for legal identification, medical diagnosis, or any purpose where accuracy of likeness is legally or safety-critical.

We aim to keep Rubick available but do not guarantee any specific uptime. The Service may be temporarily unavailable due to maintenance, infrastructure issues, or outages at third-party providers (Google Gemini, Supabase, Vercel).

We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice where possible. If we discontinue the Service entirely, we will provide at least 30 days notice and offer a refund for unused credits.

To the fullest extent permitted by applicable law, Rubick and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of profits, or reputational harm.

Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the total amount you paid us in the 3 months prior to the claim.

Some jurisdictions do not allow limitation of certain warranties or liabilities. In such cases, our liability is limited to the maximum extent permitted by law.

By you. You may delete your account at any time from Settings → Delete account. Deletion is immediate and permanent: your sign-in, photos, generated images, and profile are removed right away. Some records (such as transaction history) may be retained in anonymized form where required by law. Unused credits are non-refundable upon voluntary account closure.

By us. We may suspend or terminate accounts that violate these Terms, with or without prior notice depending on the severity of the violation. In cases of good-faith error (e.g. accidental policy trip), we will restore access where possible.

We may update these Terms as the Service evolves. Material changes will be communicated via email to your registered address at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of Mongolia. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Ulaanbaatar, Mongolia.
